Supportive Living Program (SLP) Camera/Surveillance Policy

Act
by Aug 31, 2027
Effective date
Oct 1, 2027
Identified
Oct 17, 2026

Summary

Illinois HFS requires Supportive Living Program providers to keep surveillance camera use rare, individually assessed, and thoroughly documented when privacy is limited, and never a default practice. Cameras may be used in non-resident operational spaces for basic building security or operational purposes, provided placement does not materially reduce resident privacy in HCBS service areas. Cameras are prohibited in resident dining, activity, and therapy rooms or comparable service areas, and in bathrooms, changing areas, and toileting areas under any circumstances, and audio monitoring in resident spaces is prohibited.

What to do

by Aug 31, 2027 · 9 steps
01SLP provider attestation of compliance will be required.
02Effective October 1, 2027, the new camera requirements apply, and the WY28 Annual Survey Tool will be updated to reflect them.
03SLP provider settings shall adopt policies and staff training that align with HFS guidance on camera use.
04Do not use cameras as a standing rule, a routine supervision tool, a generalized risk-management practice, or a substitute for staffing.
05Do not install or operate cameras in bedrooms as a provider practice or upon legal guardian or POA request, unless the use is an individualized HCBS rights modification that has been reviewed, approved, documented, and time-limited in the resident's ISP.
06Residents may install cameras with audio, streaming, or video recording without hardwiring in their single apartment without SLP consent, and the SLP must discuss and document that decision in the ISP.
07Post signage at the resident's apartment door stating that camera monitoring is being conducted within the apartment, and do not place cameras in bathrooms.
08Post signs in non-private areas where cameras are present, and document notice to individual residents in the ISP.
09Staff must report any unapproved, excessive, or blanket surveillance practice in SLP resident spaces to program leadership.
