Summary
Virginia Medicaid is eliminating the live-in caregiver exemption from Electronic Visit Verification (EVV) requirements effective October 1, 2026. All agency-directed aides and consumer-directed attendants performing personal care, respite care, or companion care services must now use EVV-compliant methods (F/EA mobile app or IVR system) to log and submit work shifts. The January 7, 2021 guidance permitting live-in caregiver exemptions is no longer valid.

Before October 1, 2026: Billing and operations teams must ensure all personal care service providers (agency-directed and consumer-directed) are trained and equipped to use EVV-compliant verification methods—specifically the Fiscal-Employer Agent's (F/EA) mobile phone application or Interactive Voice Response (IVR) system. Audit internal processes to identify any workflows currently exempting live-in caregivers and eliminate those exemptions. Communicate to all Employers of Record and attendants that portal-based submissions through the F/EA website are NOT EVV-compliant and will not be accepted. Beginning October 1, 2026, reject any personal care service claims that lack proper EVV documentation using approved methods. Contact the F/EA immediately if staff or providers encounter technical issues with the mobile app or IVR system. Verify provider enrollment and contact information in the Provider Services Solution (PRSS) portal to prevent claim payment disruptions. Non-compliance will result in claim denials by DMAS and MCOs.
