Summary

Illinois Department of Healthcare and Family Services (HFS) has updated hospital provider assessment repayment policies, allowing hospitals with unpaid assessment obligations to enter into renegotiated repayment agreements with terms of up to 72 months in equal monthly installments. Effective immediately, HFS will no longer accept new tax deferral plans (as of July 1, 2026), and hospitals must comply with repayment agreements or face immediate collection action including asset liens and payment recoupment from MCOs and state agencies.

REQUIREMENTS: - Immediately: If your healthcare practice operates as a hospital in Illinois with an unpaid provider assessment obligation, contact HFS at HFS.ProviderAssessmentUnit@illinois.gov to determine eligibility for the renegotiated repayment plan agreement. - By September 13, 2026 (30 days from policy date): If participating in renegotiation, obtain signed renegotiated agreement from HFS and prepare to begin monthly ACH or check payments by the 25th of each month within 30 days of agreement execution. - Ongoing: Finance/billing team must establish mandatory compliance monitoring for repayment plan obligations. Set up automated payment scheduling for monthly installments (due by the 25th of each month). Document all payments made and maintain proof of compliance. - Immediately: Ensure billing and collections teams understand that noncompliance with any repayment agreement without prior written HFS approval will trigger immediate collection action, including asset liens, reimbursement withholding from MCOs, and payment offsets from any state agency. - For hospitals with existing repayment agreements (pre-June 1, 2026): Review existing terms and contact HFS regarding renegotiation opportunity to potentially reduce monthly obligations or extend repayment timeline to 72 months maximum. CONSEQUENCES: Failure to comply with repayment plan terms will result in administrative/judicial collection action, placement of liens on hospital assets, withholding of all reimbursements (including MCO payments), and state agency payment recoupment.
