Summary
Texas HHS removed the prohibition that prevented Community First Choice (CFC) personal attendant services/habilitation providers from living with service recipients in HCS and TxHmL programs. Seven consumer-directed services forms have been updated to reflect this policy change, and instructions pages have been revised for plain language compliance. Spanish versions of FAQs are now available.
Action Required
By September 10, 2026: Billing and provider credentialing teams must review and implement the updated CDS forms (1583, 1726, 1734, 1735, 1735-cfc, 1735-hcs, 1735-txhml) in all enrollment packets and provider onboarding materials. Update internal policies and staff training to reflect that CFC/PAS/HAB providers may now reside with service recipients. Download updated forms from the CDS Forms link on the Consumer Directed Services Handbook page. Ensure both English and Spanish versions are available where indicated. Verify that billing system validations do not reject claims based on the removed co-residence restriction. Contact CDS@hhs.texas.gov if clarification is needed on implementation.
