Summary
Kentucky HB 2 requires providers to collect and submit Provider Attestation forms for all individuals currently on Michelle P. Waiver (MPW) or Home and Community Based (HCB) Waiver waitlists by January 31, 2027. The attestation must include primary diagnosis, required waiver services, and provider signature from eligible clinicians. Individuals who do not submit attestations will be removed from the waitlist after documented outreach attempts.

By January 31, 2027: Billing and clinical teams must implement a tracking system to identify all patients on MPW or HCB Waiver waitlists at your practice. For each affected patient, obtain and complete the Provider Attestation Form (available from CHFS) with: patient's primary diagnosis, required waiver services, and signature from an eligible provider (MD, DO, APRN, or licensed psychologist). Submit completed forms to the appropriate state department before the deadline. Update patient records to document attestation submission. Establish a communication protocol to notify patients and families of this requirement and offer assistance with documentation. Failure to submit by the deadline will result in patient removal from the waitlist after three documented contact attempts over 90 days plus a final 60-day notice. Designate a team member to monitor responses and track submission status.
