Summary
New Jersey DDD/NJFC Medicaid now permits qualified temporary employment agencies to provide staffing for specific services (behavioral supports, day habilitation, therapy services, and individual/community-based supports) to approved providers. Temporary employment agencies must obtain their own NJFC Medicaid Provider ID and maintain vendor contracts with the primary provider. The primary provider remains responsible for billing and ensuring all temporary staff meet licensure, certification, and DDD/NJFC Medicaid requirements.
Action Required
Immediately: (1) Billing team must verify that any DDD/NJFC Medicaid-approved providers using temporary employment agencies have obtained independent NJFC Medicaid Provider ID Numbers for those agencies through DXC Technology (609-588-6036). (2) Confirm that vendor contracts between the primary provider (contractor) and temporary employment agency (subcontractor) are in place and outline: reimbursement rates, staff profiles, continuous vetting requirements, and attestation that all staff meet State/federal licensure and certification requirements. (3) Ensure the primary provider (not the temporary agency) is billing DXC for all services rendered by temporary staff. (4) Implement controls to validate that temporary staff meet all DDD/NJFC Medicaid requirements before processing claims. Failure to comply may result in DMAHS recovery of Medicaid reimbursement paid for services rendered by non-compliant employees and potential civil/criminal sanctions against the contractor or subcontractor.
